Welcome to Liggett’s Supply. These Terms of Service (“Terms”) govern your use of our website, online store, and related services. By accessing our website, creating an account, placing an order, or purchasing products from us, you agree to these Terms.

Throughout these Terms, “Liggett’s Supply,” “we,” “us,” and “our” refer to Liggett’s Supply. “You” and “customer” refer to any person accessing our website or purchasing products from us.

Please review these Terms carefully before using our website or placing an order.

1. Online Store Terms

By using this website, you represent that you are legally capable of entering into a binding agreement or are using the website with the permission of a parent or legal guardian.

You may not use our website or products for any unlawful purpose or violate any applicable local, state, or federal law while using our services.

We reserve the right to refuse service, cancel transactions, limit quantities, or restrict access to the website when reasonably necessary to protect our business, customers, employees, or systems.

2. Product Information

We make reasonable efforts to ensure that product descriptions, specifications, photographs, dimensions, colors, pricing, and other information displayed on our website are accurate.

However, manufacturers may change packaging, specifications, colors, product designs, model numbers, or other characteristics without notice.

Images displayed on the website are intended for general representation. Actual colors, grain patterns, textures, packaging, dimensions, or appearance may vary.

If an exact characteristic is critical to your project, please contact Liggett’s Supply before purchasing.

3. Building Materials and Natural Product Variation

Lumber, treated lumber, plywood, OSB, siding, roofing, stone, concrete products, landscaping materials, and other building products may naturally vary in appearance, dimensions, moisture content, color, texture, grain, straightness, or finish.

Minor variations that are customary for the product or industry do not necessarily constitute a defect.

Customers are responsible for inspecting materials within a reasonable period after pickup or delivery and notifying us promptly of any significant damage, shortage, or incorrect material.

4. Customer Measurements and Product Suitability

Customers are responsible for providing accurate measurements, quantities, specifications, model numbers, dimensions, colors, and other information when placing an order.

Unless expressly agreed to in writing, Liggett’s Supply is not responsible for errors resulting from incorrect measurements, quantities, plans, specifications, or information provided by the customer.

Product recommendations provided by employees are based on the information available at the time and do not replace the responsibility of the customer, contractor, installer, engineer, architect, electrician, plumber, or other qualified professional to determine whether a product is suitable for a particular application.

Customers are responsible for ensuring that products and installations comply with applicable building codes, manufacturer requirements, permits, and regulations.

5. Pricing

We make reasonable efforts to maintain accurate pricing. However, pricing errors may occasionally occur.

Prices may change without notice due to manufacturer increases, commodity markets, freight costs, promotions, supply conditions, or other factors.

If a product is listed at an incorrect price because of a typographical, technical, supplier, or system error, we reserve the right to correct the price before fulfilling the order.

If you have already paid for an affected order, we will give you the opportunity to approve the corrected price or cancel the affected item for a refund.

6. Inventory and Availability

Website inventory information may not always reflect real-time store inventory.

An item appearing “in stock” online does not guarantee that the product is physically available when your order is processed.

Inventory discrepancies, damaged merchandise, simultaneous in-store purchases, supplier issues, or system delays may affect availability.

If an item becomes unavailable after you place an order, we may contact you to offer a substitute, backorder the product with your approval, remove the unavailable item, or issue a refund for the affected item.

7. Orders

Submitting an order through our website does not necessarily mean the order has been accepted.

We reserve the right to:

  • Limit quantities purchased.
  • Refuse or cancel an order.
  • Correct pricing or product-information errors.
  • Request additional information before processing an order.
  • Cancel orders involving suspected fraud or unauthorized activity.

If we cancel an order after payment has been collected, the applicable amount will be refunded using the original payment method when reasonably possible.

8. Payment

You agree to provide current, complete, and accurate billing and payment information.

Payment must be successfully authorized before an online order is completed unless other payment arrangements have been expressly approved by Liggett’s Supply.

Payment processing may be handled by Shopify or other third-party payment providers. Your payment information may therefore also be subject to the terms and privacy practices of those providers.

9. Taxes

Applicable sales taxes will be collected as required by law.

Customers claiming a tax exemption are responsible for providing valid and current exemption documentation acceptable to Liggett’s Supply.

10. Local Pickup

Orders designated for store pickup should not be considered ready until you receive confirmation that the order has been prepared.

Customers may be required to provide identification, an order number, or other verification before merchandise is released.

Orders that are not picked up within a reasonable period may be subject to cancellation, restocking, or other action after reasonable attempts to contact the customer.

11. Local Delivery

Delivery availability, fees, service areas, scheduling, and minimum-order requirements may vary.

Delivery dates and times are estimates unless expressly guaranteed in writing.

Weather, road conditions, equipment problems, supplier delays, staffing, customer accessibility, and other circumstances may cause delays.

The customer is responsible for providing a safe and reasonably accessible delivery location.

Our drivers have the right to refuse to enter a driveway, jobsite, property, or unloading location that they reasonably believe could result in injury, property damage, equipment damage, vehicle damage, or unsafe conditions.

Unless specifically agreed otherwise, delivery means transportation of the merchandise to an accessible location and does not include installation, placement inside a structure, or specialized material handling.

Customers should inspect delivered merchandise promptly and report significant shortages, incorrect products, or visible damage as soon as reasonably possible.

12. Special Orders

Products that are specially ordered, custom ordered, non-stock, manufactured specifically for the customer, or ordered in unusual quantities may require a deposit or full payment before the order is placed.

Special-order merchandise may be non-cancellable and non-returnable once the order has been submitted to the manufacturer or supplier.

Before placing a special order, customers are responsible for verifying all relevant specifications, including quantities, dimensions, colors, profiles, model numbers, sizes, and product compatibility.

Manufacturer delays and estimated arrival dates for special-order merchandise may be outside Liggett’s Supply’s control.

13. Cut, Modified, or Custom Materials

Materials that have been cut, altered, tinted, mixed, assembled, customized, or otherwise modified specifically for a customer may not be eligible for return or refund except where required by law or where the product was defective before modification.

This may include, where applicable, cut lumber, pipe, wire, chain, rope, glass, custom-mixed products, special-order materials, and other merchandise modified at the customer’s request.

Customers are responsible for confirming measurements and specifications before customized work is performed.

14. Returns and Refunds

Returns and refunds are subject to our current Refund / Return Policy.

Certain merchandise may have additional restrictions due to its condition, manufacturer requirements, hazardous-material considerations, custom nature, seasonal status, or other factors.

Nothing in these Terms is intended to eliminate any consumer right that cannot legally be waived.

15. Manufacturer Warranties

Certain products may include warranties provided by their manufacturers.

Unless expressly stated otherwise in writing, manufacturer warranties are provided by the manufacturer and are subject to the manufacturer’s own terms, exclusions, registration requirements, and claims procedures.

Liggett’s Supply may assist customers with manufacturer warranty information when reasonably possible, but we do not control a manufacturer’s decision regarding warranty approval.

16. Third-Party Products and Services

Our website may contain links to, integrations with, or services provided by third parties, including Shopify, payment processors, manufacturers, social media platforms, and other service providers.

We are not responsible for the content, availability, policies, security, or practices of third-party websites or services.

Use of third-party services may be subject to separate terms and privacy policies.

We do not guarantee that the website will always be uninterrupted, secure, error-free, or available.

We may temporarily suspend or modify portions of the website for maintenance, security, upgrades, technical problems, or other operational reasons.

Unless otherwise stated, content created for the Liggett’s Supply website—including our name, branding, logos, graphics, photographs, written materials, website design, and other original content—is owned by or licensed to Liggett’s Supply.

Manufacturer names, logos, trademarks, product photographs, and related materials remain the property of their respective owners.
